Se declaró la nulidad de todo lo actuado a partir del auto que rechazó la demanda de tutela de la referencia, toda vez que la Sala consideró que la peculiar manera utilizada para la notificación fue impropia e inútil y que omitió las diligencias encaminadas a informar al demandado mediante la utilización del medio más expedito y eficaz.

En consecuencia, se devolvió el expediente al juez de conocimiento para que tramite el proceso en debida forma y emita el pronunciamiento sobre el fondo del asunto.

PRIMERO. Declarar la nulidad de todo lo actuado a partir del auto de treinta de enero de mil novecientos noventa y seis (1996).
SEGUNDO. Ordenar al Juzgado Once Penal Municipal de Cali que adelante el proceso en debida forma, de aplicacion al articulo 16 del decreto 2591 de 1991 y falle de fondo el presente asunto.
TERCERO. Devolver el expediente al despacho de origen para que se notifique este fallo a la actora y para dar cumplimiento a lo resuelto.
